It's Michelle's Life is a registered business name of Balance Eleven Pty Ltd (ABN 75 683 468 037), a small Australian business operated from WA, offering downloadable nutrition guides, recipes, and an online membership community at itsmichelleslife.com.au. In these terms, “we”, “our”, and “us” means Balance Eleven Pty Ltd trading as It's Michelle's Life, and includes all officers, directors, employees, contractors, and affiliates. “You” and “your” means the client, visitor, website user, or participant in our courses.
Definitions
- Content means any and all material available on the website or as part of a course or membership, including but not limited to videos, text, images, audio, PDFs, ebooks, workbooks, assignments, recipes, and interactive activities.
- Course means a structured program of Content accessed online, designed to provide participants with specific skills and knowledge.
- Membership means a recurring subscription giving ongoing access to our members' area, such as The Club.
- Products means any digital goods offered for sale, such as nutrition guides, ebooks, and recipe collections.
Changes to these terms
We reserve the right to change, modify, add, or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and our rights and obligations to each other.
Eligibility
You must be over 18 years of age to use this website and to purchase any goods or services. Our services are not directed to persons under 18 and we do not knowingly collect personal information from anyone under 18.
Licence to use our Content
Upon acceptance of these Terms, we grant you a non-exclusive, non-transferable, limited licence to access and use our Products, Courses, and Membership Content.
Our Products, Courses, and Content may only be used for your own individual, personal, non-commercial use. You may view, browse, and search our Content but only store, download, or print a maximum of one copy of our Content for your own personal use.
You agree not to:
- modify, alter, disassemble, decompile, translate, or convert into a human-readable form or reverse engineer all or any part of our Content;
- share, sell, licence, or distribute any of our Content to third parties, or use our Content in any part or whole in any commercial venture, business, or package, or in any way for sale, licence, or distribution, without our written consent;
- store or use our Content in any database or other storage facility, in either paper or electronic form, which is meant to provide public access to knowledge or information;
- in any other way reproduce, copy, download, scrape, store, publish, transmit, re-transmit, transfer, communicate, distribute, disseminate, broadcast, circulate, sell, resell, or otherwise use our Content or any part or portion of our Content in any form or by any means.
Any unauthorised use of our Content will result in your licence being terminated and may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties. We reserve the right to disclose your name and any other personal details to any law enforcement authority or other competent authority, or to any person for the purpose of legal proceedings, prosecution, investigation, or any breach or alleged breach of the law or these terms.
Delivery of digital goods
Our Products are delivered digitally and are generally available immediately after purchase, via your It's Michelle's Life account or via the email address you provided at checkout. Please be aware there are inherent risks associated with downloading any software and digital goods. Should you have any technical problems accessing or downloading any of our Products, please contact us at hello@itsmichelleslife.com.au so we may try to assist you.
If we ever offer physical goods, delivery may be via Australia Post or other reputable courier companies, typically taking between 2 and 14 days depending on the delivery option. Damaged or lost orders should be resolved with the carrier directly, and we are not responsible for physical goods that are damaged in transit or not received. Replacement of damaged or lost items is made at our discretion.
Refunds and cancellations
Products and courses paid for in a single payment
We offer a refund if you are not satisfied with the Product or Course within 7 days of the purchase date. Refund requests must be made in writing to hello@itsmichelleslife.com.au with a reason for the refund request.
No refund will be issued if you have accessed more than 50% of our Course Content. Refunds will be processed within 10 business days of the request being received and approved, and will be made through the same method of payment as the original purchase.
We reserve the right to deny any refund request that does not meet the above conditions, is deemed to be fraudulent, or if you have violated these Terms. We reserve the right to change or update our Products, Courses, Content, pricing, and refund policy at any time and without notice.
Monthly memberships and subscriptions
We do not offer refunds for payments made on our month-to-month subscription plans (“Subscription”).
Your Subscription will continue on a month-to-month basis unless and until you cancel, or the Subscription is suspended or discontinued by us. If you cancel your Subscription, the cancellation will be effective at the end of the current monthly period. You will continue to have access to our Memberships and Courses for the remainder of that period, but you will not receive a refund.
Where you have been offered a free trial period, if you do not cancel during the free trial period you will be billed for the month-to-month Subscription at the end of the free trial period and will not be able to request a refund.
Where you have paid an upfront annual fee in advance for your Subscription, you have 30 days from the date of purchase to cancel the remainder of your Subscription and will receive a pro-rata refund for the remainder of the prepaid amount, less an administrative fee.
We reserve the right to change or update our Subscription plans, refund, and cancellation policy at any time and without notice. Any changes to your Subscription plan will take effect following notice to you for the months after your next payment.

Results disclaimer
We do not promise, warrant, or guarantee any particular results from any of our Products, Courses, Content, or information. Results vary from individual to individual, and the performance, progress, and success of any Course or Product will depend on your own situation, participation, and factors beyond our control. Any actions you take or decisions you make based on information in our Courses or on our website are made at your own risk.
Limitation of liability

By using our services, you agree that It's Michelle's Life is not to be held liable for any decisions you make based on any of our services or guidance, and any consequences as a result are your own. Under no circumstances can you hold It's Michelle's Life liable for any actions you take, nor can you hold us or any of our employees liable for any loss or costs incurred by you as a result of any guidance, advice, coaching, materials, or techniques used or provided by It's Michelle's Life.
All our information on both the website and in consultations is intended to assist you and does not in any way, nor is it intended to, substitute professional, financial, medical, or legal advice. Results are not guaranteed and It's Michelle's Life takes no responsibility for your actions, choices, or decisions.
Whole agreement

Governing law and jurisdiction
These Terms are governed by the laws from time to time in force in Western Australia. Both parties agree to unconditionally submit to the exclusive jurisdiction of the Courts of Western Australia for determining any dispute concerning these Terms.
